‘My father used to say that I will become CJI, when the dream came true, he is no more’, Chief Justice BR Gavai got emotional

Nagpur: Chief Justice of Supreme Court BR Gavai reached Nagpur on Saturday to attend the felicitation ceremony organized by Nagpur District Lawyers Association. During this, he became emotional remembering his father. He said, ‘My father always felt that one day I would become the Chief Justice of the Supreme Court. But today when that dream has come true, he is not in this world to see it.’

CJI Gavai gave his speech in Marathi during this time. He said, ‘Has anyone read my Oxford speech? I had said in it that judicial activism will remain permanently. It is necessary to protect the Constitution and ensure the rights of the citizens.’

‘Limits of all three branches of the Constitution determined’
He said, ‘At the same time, I am also in favor of the idea that the Indian Constitution has determined the limits of its three branches – legislature, executive and judiciary. Making laws is the function of the legislature.

Whether it is Parliament or various state assemblies, the executive is expected to work according to the Constitution and the law. When a law is made outside the limits of Parliament or Assembly, and it violates the principles of the Constitution – then the judiciary can intervene in it.’

‘The judiciary should not interfere in every matter’
However, he also said that the judiciary should not interfere in every matter. The CJI said, ‘If the judiciary tries to interfere in the area of ​​the executive and the legislature in every matter, then I always say – judicial activism is necessary, but it should not be allowed to turn into judicial audacity and judicial terror.’

On this occasion, CJI Gavai became emotional. He said, ‘My father also used to say that one day I will become the Chief Justice of the Supreme Court. But he did not live to see this. He passed away in 2015. His absence is felt. I am happy that my mother is here to see this moment.’
