US court gave a big blow to Donald Trump, declared the tariff illegal, President said – this decision will destroy the country

New Delhi. On Friday, an appeals court, creating a stir in the politics and economy of America, declared most of President Donald Trump’s tariffs illegal. The US Court of Appeals for the Federal Circuit says that the President has emergency powers, but he does not have the right to impose tariffs or taxes.

This decision is considered a big blow to Trump’s economic policies. According to the AP report, the court also allowed the tariff to remain in place till October 14, giving the Trump administration an opportunity to take the matter to the Supreme Court.

On the other hand, President Trump rejected the court’s order outright and said that all tariffs will remain in force. He called the court’s decision wrong and biased and said that if it is allowed to remain like this, this decision will destroy America. We will use the tariff in the interest of our nation with the help of the Supreme Court.

Trump called the court biased
Trump wrote on the social media platform Truth Social, “All tariffs are still in place. Today a highly biased appeals court wrongly said our tariffs should be removed, but they know that in the end America will win. If these tariffs are ever removed, it will be a big disaster for the country.”

Trump also raised the issue of trade deficit and unfair tariffs imposed by foreign countries in his statement. He wrote, “America will no longer tolerate huge trade deficits and unfair tariffs and non-tariff trade barriers imposed by other countries, whether they are friends or enemies, which weaken our producers, farmers and everyone else. If it is allowed to remain like this, this decision will literally destroy America.”

Trump administration will resort to the Supreme Court

For many years, our careless and unwise politicians allowed tariffs to be used against us. The Washington DC-based US Court of Appeals for the Federal Circuit said that the law gives the President the power to take many actions after declaring a national emergency, but nowhere is there any mention of permission to impose tariffs or taxes.

This decision is related to the reciprocal tariffs imposed in April and the tariffs imposed on China, Canada and Mexico in February. However, this decision will not affect the tariffs issued under other legal provisions of Trump (such as tariffs imposed on steel and aluminum).
Trump administration cited IEEPA

In court, the Trump administration cited the International Emergency Economic Powers Act (IEEPA) as the basis for its decisions. This 1977 law gives the President the power to take emergency steps to deal with unusual and extraordinary threats. Earlier it was used to impose sanctions on enemy countries or seize their assets.

Trump is the first US President to use IEEPA to impose tariffs. He argues that the country is threatened by the ever-increasing trade deficit, weakness in American manufacturing and drug trafficking. On this basis, he imposed tariffs on China, Canada and Mexico and said that these countries have failed to stop the smuggling of illegal fentanyl.

However, the court says that while creating IEEPA, Congress did not intend to give the President the power to impose unlimited tariffs. According to the Constitution, the power to impose taxes and duties lies with Congress. Even if this power is handed over to the President, it should be clear and limited.

Earlier too the court had declared the tariffs unconstitutional
Earlier, the New York-based US Court of International Trade had also said on May 28 that Trump had imposed these tariffs in violation of his rights. This three-judge panel also included a judge who was appointed by Trump himself. Similarly, another court in Washington had also declared the imposition of tariffs under IEEPA unconstitutional. So far at least eight lawsuits have challenged Trump’s tariff policies, including the case of the state of California.
