Hindu Deities Remarks Row: Delhi Court Seeks Police Report on FIR Plea Against Student Activist Nishu Azad and Father

New Delhi: A Delhi court on Wednesday sought an Action Taken Report from the Delhi Police on a petition seeking registration of an FIR against student activist Nishu Azad and her father Sanjay Azad over alleged objectionable social media posts referring to Hindu deities. The petition was filed by advocate Amita Sachdeva, who had earlier approached the Delhi Police with a complaint. The court has sought details of the action taken on the complaint so far.

What Is the Allegation?
According to the petition, four posts allegedly published from Nishu Azad’s X account between September 2023 and August 2026 contained references to Hindu deities that the complainant considers derogatory. The complaint refers to alleged content concerning Lord Shiva, Lord Krishna, Goddess Saraswati and Goddess Durga. Sachdeva has alleged that the posts remained accessible online despite her request for their removal. The allegations are contained in the complaint and have not been established by the court.

Sections Invoked in the FIR Plea
Sachdeva has sought registration of an FIR under provisions of the Bharatiya Nyaya Sanhita (BNS), including Section 299, concerning deliberate and malicious acts intended to outrage religious feelings, and Section 196, concerning promotion of enmity between groups on grounds including religion. The petition also refers to relevant provisions of the Information Technology Act.

Court Seeks Action Taken Report
Chief Judicial Magistrate Mridul Gupta of the Patiala House Courts issued notice to the Delhi Police and directed the SHO of Parliament Street Police Station to submit a report detailing the action taken on the complaint. The court has not directed the police to register an FIR at this stage. The question of further action will be considered after the court examines the police report.

Next Hearing in January 2027
The matter has now been listed for January 28, 2027. The petition also seeks preservation of the allegedly offending posts and related electronic evidence, including platform records, IP logs and device-related information.

Case Comes Amid Separate CJP Protest Controversy
The proceedings come amid a separate controversy involving Nishu Azad and her father following their participation in a Cockroach Janata Party protest in Delhi. That separate matter involved allegations concerning an assault on Sanjay Azad. The current petition before the Patiala House Court, however, concerns the alleged social media posts and the request for an FIR, rather than the protest-related incident. For now, the court has sought the police’s response. Whether an FIR should be registered will be considered after the court examines the material placed before it.
