Madhya Pradesh Government to Approach Supreme Court for 27% OBC Quota, Seek Stay on High Court Order

October 13, 2026

Bhopal: The Madhya Pradesh government is preparing to approach the Supreme Court to pursue 27% reservation for Other Backward Classes (OBCs) and seek an interim stay on the High Court’s ruling on the issue.

Chief Minister Mohan Yadav held detailed discussions with Solicitor General Tushar Mehta and Madhya Pradesh Advocate General Prashant Singh in New Delhi to formulate the government’s legal strategy. The Chief Minister has directed officials to compile the necessary documents, facts and data for filing a petition challenging the High Court’s decision.

In a social media post, Yadav said he had discussed the legal implications of the ruling and the government’s next course of action with the two senior law officers.

Government Prepares Legal Challenge to High Court Ruling

The legal position concerning OBC reservation in Madhya Pradesh has come under renewed focus following a ruling by the Jabalpur High Court. According to the information available, the existing provision of 14% reservation for OBCs will remain in effect, while the additional 13% quota under the state’s 27% reservation policy remains at the centre of the dispute.

The government is now preparing to challenge the ruling in the Supreme Court and seek interim relief. Officials have been instructed to assemble the relevant records and supporting documents before the petition is filed.

Chief Minister Mohan Yadav has reiterated that the government will pursue all available legal avenues to secure 27% reservation for the OBC community.

Fate of 13% Held-Up Posts Under Scrutiny

The ruling has significant implications for government recruitment processes conducted between 2022 and 2026. During this period, recruitment results were being declared while an additional 13% of posts associated with the proposed 27% OBC quota were kept on hold.

According to the information provided, the High Court’s order directs that these posts be filled by candidates from the unreserved category within three months.

The state government intends to seek an interim stay from the Supreme Court to prevent the order from taking effect while its challenge is considered. The outcome of the proposed legal proceedings could have implications for the affected recruitment processes and candidates awaiting the resolution of the reservation dispute.

OBC Mahasabha Announces Statewide Protests on October 15

Meanwhile, the OBC Mahasabha is preparing to launch a statewide agitation demanding 27% reservation for OBCs in Madhya Pradesh.

On October 15, the organisation plans to stage protests at district headquarters across the state and submit memorandums addressed to the Chief Minister. It is also preparing to approach the Supreme Court over the reservation issue.

OBC Mahasabha member Lokendra Gurjar said the organisation would conduct a phased agitation to press for its demand.

Separately, representatives of various organisations at a meeting in Nagpur decided to build a broader movement around demands for a separate OBC census column and increased reservation. Preparations are underway for a major agitation in November.

With the state government preparing a legal challenge and OBC organisations planning demonstrations, the demand for 27% reservation is set to remain a key issue in Madhya Pradesh in the coming weeks.
