
New Delhi: Congress leader Jairam Ramesh has filed a petition in the Supreme Court challenging post-facto environmental clearances. He stated that these retroactive environmental clearances are illegal and make a mockery of governance. In a post shared on social media, Jairam Ramesh wrote, “Encouraged by the Supreme Court’s review on December 29, 2025, of its earlier decision redefining the Aravallis, I have filed a petition in the Supreme Court challenging post-facto environmental clearances.”
Congress Leader Calls Post-Facto Clearances Illegal
The former Environment Minister said, “Environmental clearances granted after the work has been completed are illegal, harmful to public health, and make a mockery of governance. They provide an easy escape route for those who deliberately violate environmental regulations.” He added that ignorance of the law is no excuse for violating it.
Last month, the Congress General Secretary urged the Supreme Court to take suo motu cognizance of three crucial environmental matters. Ramesh referred to the Supreme Court’s order in which it recalled its November 20 decision redefining the Aravallis and said it was very important and welcome.
Jairam Ramesh said that on November 18, the Supreme Court had also opened the door for a review of its earlier May 16 decision, which had stayed post-facto environmental clearances. He said, “Such clearances are against the very foundations of jurisprudence and make a mockery of governance. Retrospective clearances should never be granted.”
