The arrest of three youth workers accused of demonstrating shirtless at the AI Summit on February 19th at Bharat Mandapam in New Delhi caused widespread uproar in Shimla, the capital of Himachal Pradesh. This 20-hour drama ended at 6 a.m. on Thursday. The Himachal Pradesh and Delhi police were at loggerheads throughout the dispute, leading to intense confrontation between the police of both states. Ultimately, Delhi Police had to yield to the state police, and after following all legal procedures, the three accused were arrested and taken to Delhi. Significantly, in addition to Delhi, Haryana Police personnel were also involved in this operation.
Indeed, on Wednesday, a team of 20 Delhi Police personnel raided Chidgaon in Rohru, Shimla district, Himachal Pradesh. Three Youth Congress workers, who were involved in a shirtless protest during the AI Summit, were arrested by the police and were being taken back to Delhi. Meanwhile, in Dharampur, Solan, the Himachal Pradesh Police detained a team of 20 Delhi Police personnel, claiming that the three workers had been arrested illegally. Shimla police took the three accused and the Delhi Police personnel to the Chakkar District Court in Shimla and presented them before the court. However, the judge granted them 24 hours to appear on Thursday for details of the proceedings.
Massive uproar at the Shoghi Barrier
From the court, Delhi Police personnel left for Delhi with the three accused, but were again stopped by the police at the Shoghi Barrier in Shimla, leading to a heated argument. A heated exchange ensued between the police of the two states. A heated exchange ensued between ASP Shimla Abhishek and ACP Rohit of Delhi. The ASP Shimla told the ACP that they had not shown any documents regarding the arrest of the accused. Protocol was also not followed. During this, traffic jams occurred on the Kalka-Shimla Highway, causing significant inconvenience to the public. After a nearly two-hour standoff, the Delhi Police was forced to return to Shimla and the three accused were medically examined at Shimla’s DDU Hospital. The accused were later produced in court, where the court granted them transit remand to the Delhi Police.
Delhi Police Stopped Again by Himachal Police at Shoghi
When the Delhi Police left for Delhi with the accused on Thursday morning, the Shimla Police stopped them again at the Shoghi barrier. However, the high-voltage drama finally ended. After a nearly two-hour altercation, the Delhi Police departed from the Shoghi barrier at around 6 a.m.
At the Shoghi barrier, the Shimla Police alleged that the Delhi Police was illegally transporting the hotel’s DVR and that the vehicle containing evidence related to the case was required to be searched. Despite Shimla Police’s request at the Shoghi barrier, the Delhi Police officers did not disembark. Shimla police requested the vehicle keys and cooperation, but Delhi police refused, stating that the vehicle was case property and therefore could not be handed over. Delhi Police ACP Rahul told the media that after receiving transit remand, the accused were being taken to Delhi, but Shimla police were obstructing the action. Meanwhile, Shimla police had warned that if cooperation was not received, the vehicle would be seized. Ultimately, Delhi police handed over the seizure memo to Shimla police and departed, taking with them the DVR and the accused’s seized Thar vehicle.
Kidnapping Case Against Delhi Police
When the Delhi Police was escorting the accused from the Shimla District Court regarding this entire incident, the Himachal Police stopped them near Shoghi and informed them that a kidnapping case had been filed against the Delhi Police. The owner of the resort located in Mandli, Chidgaon, Rohru, Shimla, filed a complaint at the Chidgaon police station, stating that three Youth Congress workers were staying at his resort. On Wednesday morning, around 15-20 unidentified men in plain clothes arrived in vehicles and forcibly took away the three young men. The complaint also states that the DVR of the CCTV cameras installed on the resort premises was also taken without any form or receipt. Based on the complaint, the police have registered a case at the Chidgaon police station. The Delhi Police did not even inform the local police about the incident. It is noteworthy that the Delhi Police arrived in five vehicles with Delhi and Haryana registration numbers.
A case has also been filed against the Himachal Police in Delhi.
According to Delhi Police sources, after the arrest of three individuals in Himachal, the Delhi Police Special Cell team was returning with the accused, but the Himachal Police stopped the Delhi Police in Solan. Following this, the Delhi Police Special Cell also filed a cross-FIR, alleging obstruction of government work.
Court Grants Transit Remand
Delhi Police lawyer Nand Lal stated that the ACJM court has handed over the three accused to the Delhi Police on transit remand. The Delhi Police will now take them to Delhi and present them before a magistrate there. It is noteworthy that the Delhi Police arrested Saurabh Singh and Arbaaz Khan from Uttar Pradesh and Siddharth Avadhoot from Madhya Pradesh from the Rohru area of Shimla district. The Delhi Police will now present the three accused before a local magistrate in Delhi. The petitioner’s lawyer, Sandeep Dutta, stated that the Delhi Police did not follow proper procedure and that the three accused were arrested illegally.
Former CM launches verbal attack on Sukhu government
Former CM and Leader of the Opposition Jairam Thakur has demanded action against Himachal Police officials who attempted to arrest Delhi Police officers and employees who had come to apprehend the accused. Speaking to reporters in Mandi, Jairam Thakur said that this was an unfortunate incident. At Rahul Gandhi’s behest, the state government orchestrated a conspiracy to disrupt the AI Summit at Himachal Bhawan in Delhi and tarnish the country’s image. Subsequently, the three accused were brought to Himachal in an elected representative’s vehicle and placed under government shelter in Rohru. When Delhi Police arrived to arrest the accused, the police team was detained in Dharampur, Solan district. However, when the Superintendent of Police failed to provide a convincing explanation in court, the police action taken was condemnable and unheard of in the state’s history. Meanwhile, there has been no response from the Sukhu government on this matter. Shimla Superintendent of Police Gaurav Singh also appeared in the district court, but he too did not speak to the media.
