New Delhi: Donald Trump has issued several executive orders after taking oath as US President. Under Trump’s order, the constitutionality of citizenship based on birth in America has been abolished, which is also being opposed across the country. But now this order has been challenged in the court.
22 states dominated by the Democratic Party and many civil rights groups have challenged this executive order of Trump in the court. A case has been registered in the court in this regard.
Along with the Democratic-dominated states, the District of Columbia and San Francisco filed the first case in the federal court of Boston on Tuesday. It was said that this decision of President Trump is a violation of the US Constitution. After this case, the American Civil Liberties Union and the Immigrants Organization also approached the court.
New Jersey’s Democratic Attorney General Matthew Platkin said on Tuesday that the court has been approached to stop Trump’s order. The President has extensive powers, but he is not an emperor. By going to court against Trump’s decision, a clear message has been sent to the Trump administration that we will stand up for our people and their basic constitutional rights.
What does the US law say?
Under the 14th amendment to the US constitution, there is a provision to grant citizenship on the basis of birth. This means that every child born in America automatically becomes a citizen of America, regardless of the citizenship of his parents.
Let us tell you that this constitutional amendment was implemented in 1868 with the aim of giving equal rights to everyone in America. But since then, the issue of illegal immigrants and infiltration has been raised continuously by political parties. Trump was especially against this and he passed a resolution against changing the law as soon as he took oath.
Trump’s order is contrary to the US law which grants citizenship to every child born there. But according to the new order, if a child wants US citizenship at birth, then it will be mandatory for one of his parents to be an American citizen. Also, one of them should have a green card or one of them should be in the US army.
